Ensure the right to work in Sweden
- The host department is responsible for carrying out checks to ensure that third country nationals (i.e. nationals of a foreign country that is not an EU country, an EEA country or Switzerland) have the right to work in Sweden.
- The individual must have applied for and been granted a work- and residence permit before entry into Sweden.
- If the work permit is to be extended, the individual has the right to work while awaiting the permit to be granted, provided that the application is made before current work permit expires. If the person has another residence permit than a work permit, or is about to change from one residence permit to another, other rules may apply. The Migration Agency has made a gudie that shows which residence permits can be applied from Sweden.
- According to the Aliens Ordinance (2006:97) Chapter 6, section 13 a §, the employer must hold a copy of documents during the employment and 12 more months, verifying an individuals right to resist and work in Sweden.
- Checking of work- and residence permit may not be made in a discriminatory way. To avoid this happening, an identity check of all new employees should be done. The aim of this identity check is to determine if the person is a third-country national and if the verification of work- and residence permit is necessary.
